What is the Indigent Defense Expenditure Report?

The Indigent Defense Expenditure Report (IDER) is an annual report submitted by county auditors and financial officers that includes expenditures, case and appointment counts, and attorney information for each court with adult criminal, juvenile delinquency, and family protection representation cases and appointments.

Adult Criminal and Juvenile Delinquency IDER

In the Adult Criminal and Juvenile Deliquency IDER, counties report all eligible criminal and juvenile delinquency indigent defense expenditures, case counts and attorney information for each court, sorted by level of case, type of expenditure and attorney, pursuant to Government Code § 79.036(e). Family Protection Representation IDER

"In the Family Protection Representation Indigent Defense Expenditure Report, every fiscal year, counties report expenditures and appointments for court-appointed legal representation of parents, non-parent conservators, and children in Child Protective Services (CPS) cases pursuant to Government Code § 79.0365. What is considered a Family Protection Representation appointment?

A Family Protection Representation appointment is when a court-appointed attorney is representing a parent, child, or other party in a lawsuit filed by the Texas Department of Family and Protective Services against a parent, commonly referred to as a Child Protective Services or CPS case. Counties should report an appointment one time each year an expenditure is paid on the appointment. This is not the same as a court case or invoice.
